Judge Rejects Martinez’s Restraining Order Request Against Berry
The ruling came after two weeks of hearings in the former couple’s custody dispute. Berry has denied allegations that she physically abused their 13-year-old son, Maceo. She had asked the court to dismiss the restraining order request and lift temporary limits on her contact with him.
Martinez retained primary physical custody after the decision. Berry’s visits remain limited to daytime, without overnight stays. She is pursuing exclusive legal decision-making power, which could give her more say in matters concerning Maceo’s education, medical care and mental health, and wants their previous 50-50 physical custody arrangement restored.
In court papers filed before the session, Berry’s lawyers alleged that Martinez had disrupted their son’s schooling and therapy, while drawing him into his parents’ legal disputes. Her fiancé, musician Van Hunt, has supported her during the case and testified on her behalf. Berry’s attorney called Martinez’s claims meritless and misleading.
Berry and Martinez married in 2013 and announced their separation in 2015. Their divorce was finalized in 2023, with an agreement on joint custody. The latest ruling followed years of disputes over parenting arrangements, including an agreement in 2024 to attend sessions aimed at resolving co-parenting conflicts. Berry’s request for changes to custody remains part of the legal battle.
