Idaho Supreme Court Hears Lori Vallow Daybell Appeal
On November 2, attorneys presented arguments to the Idaho Supreme Court about whether Lori Vallow Daybell’s convictions in the deaths of her two children and conspiracy to kill Tammy Daybell should be overturned. The court will issue its ruling later.
Court Weighs Vallow Daybell’s Right to Choose Her Lawyer
The Idaho Supreme Court is weighing whether Lori Vallow Daybell received a fair trial after a lower-court judge disqualified the lawyer she wanted. On November 2, her attorney argued that the decision violated her right to counsel and that the judge treated prior joint representation as proof of a conflict without sufficient evidence.
Vallow Daybell is seeking to overturn convictions tied to the deaths of her children, Joshua “JJ” Vallow and Tylee Ryan, and a conspiracy to kill Tammy Daybell. The children’s bodies were found buried on property belonging to Chad Daybell, whom Vallow Daybell married weeks after Tammy Daybell’s death. Vallow Daybell received life sentences in Idaho.
Prosecutor Jeff Nye defended the judge’s decision, saying the former lawyer had represented Chad Daybell and had filed confidential information. He argued the court had to address an unusually difficult situation and protect the integrity of the proceedings. The justices also discussed whether jurors should have heard evidence about shootings in Arizona, which prosecutors said illustrated the defendants’ conduct. The court will rule later.
Idaho Justices Scrutinize Challenge to Vallow Daybell Trial
The Idaho Supreme Court heard a challenge to Lori Vallow Daybell’s convictions on November 2, with prosecutors defending a lower-court judge’s decision to remove her preferred lawyer. The dispute centers on whether the attorney’s representation of both Vallow Daybell and Chad Daybell created a conflict that justified disqualification.
Vallow Daybell’s lawyer, Craig Durham, argued the court had not established an actual conflict and that his client was denied a chance to participate after the court dismissed her attorney. He said a judge could have appointed separate conflict counsel. Vallow Daybell is asking the court to overturn convictions involving the deaths of her two children and a conspiracy to kill Tammy Daybell.
Prosecutor Jeff Nye said the former lawyer had represented Chad Daybell, filed confidential information, and continued submitting documents while Vallow Daybell had been deemed incompetent. He argued the judge had a duty to ensure the case proceeded ethically. The justices also considered arguments about evidence from Arizona shootings and other trial issues, though those matters received less attention at the hearing. The court will issue its decision later.
