Two San Jose Officers Arrested in Evidence-Tampering Investigation

The San Jose Police Department said its investigation began in August after a bag of suspected narcotics listed in a May 3 arrest report filed by Surry was found to be missing. Surry, 29, and Thompson, 30, are each accused of mishandling evidence and submitting a false account to police. The allegations have not been proven.

Police said Surry was told the bag was missing. On August 12, he allegedly stopped and searched a pedestrian who was unrelated to the earlier arrest, took a similar bag of suspected narcotics and did not pursue enforcement action. Investigators allege he later entered that bag into evidence under the May 3 case number without recording the stop or seizure.

Thompson is accused of reviewing body-camera video from Surry’s May 3 arrest to help him substitute for the missing material. The officers are in a relationship and live in Gilroy. Surry was placed on administrative leave September 2, and Thompson on September 18.

Police said they found no evidence of other report discrepancies or similar conduct by the officers. The department said it acted to remove both from duty and pursue criminal accountability.
